INTRODUCTION

This Privacy Policy (the “Policy”) governs your use of the Dayton Superior Searcher mobile application (the “Application”). This Policy is designed to inform you of how the Application works, what information may be gathered during your use of the Application, and what use may be made of that information. By agreeing to the terms of this Policy, and separately by using the Application, you consent to the Policy and to the collection, processing, disclosure and use of your information as described in this Policy. Dayton Superior reserves the right to modify the terms of this Policy in its sole discretion, and your continued use of the Application after the modified Policy is available shall constitute your consent to the revised Policy. Should you not wish to have your information gathered or used as described, you should uninstall the Application from the device (or devices) on which you have downloaded it.

HOW DOES THE APPLICATION WORK?

You may download the Application from one or more application distributors (“App Stores”). You may be required to provide information about you and your mobile device(s) in connection with that process, or in connection with updating the Application. Dayton Superior does not control or direct what information may be gathered in connection with your downloading of the Application from an App Store, nor does it control or direct how that entity may gather, use, process, transfer or disclose that information. You should contact the App Store should you have any questions about its use of your information.

Once you install the Application on you mobile device(s), any information you submit is processed on Dayton Superior systems, and is available to employees of Dayton Superior who may access the information and use it as described below. Your information may be stored and processed on systems located both within and outside of the United States.

WHAT INFORMATION DOES THE APPLICATION COLLECT?

The Application collects information that you submit through it. The Application may collect your name, email address and authentication information (including user identification and the like). Registration may be required to use certain functions of the Application; if and when you register, the Application will collect identifying information, including your name, email address and authenticating information. You are not required to register on the Application, but if you do not register certain features and functions may not be available for your use.

We do not use the Application to knowingly collect or solicit information from, or to market to, children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at Info@DaytonSuperior.com and we will delete the information within a reasonable time.

In addition, the Application may collect certain information automatically, such as the type and unique mobile ID of your device, the type of your mobile operating system and browser you are using, your geolocation and information about how you are using the Application. We may use geolocation functions to provide you information about store locations and to facilitate service delivery.

HOW IS YOUR INFORMATION USED?

We may use your information to contact you from time to time about Dayton Superior news, products and services, and to provide promotions and offers. We also may use your information to improve the Application and to improve your experience with it. Your information also enables you to use certain features and functions of the Application, and it is used for that purpose.

We generally do not share your personally identifiable information with third parties. However, we may share or transfer your information (1) as required by law, such as to comply with a subpoena, warrant or similar legal process; (2) when we believe in good faith that the disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud or respond to a government request; or (3) to a successor to Dayton Superior’s business or assets when a transaction transfers Dayton Superior’s rights in the Application. We also may transfer or disclose anonymised or aggregated information to parties that assist us in designing, operating or improving the Application.

We are concerned with safeguarding your information. We provide physical, electronic and policy safeguards to protect information we collect, process and maintain. Please be aware that, although we endeavor to provide reasonable security for information we collect and use, no security system can prevent all unauthorized access to, use or disclosure of personal information.
